These Terms of Service govern your use of the website www.kialarise.com, operated by Kiala Rise, a company based in Portugal. By accessing our website or purchasing from our store, you agree to these Terms. If you do not agree with any part, you should not use our services.
1 – Legal Framework
This website and all commercial activities are governed by Portuguese law and applicable European Union regulations, including:
- Decreto-Lei n.º 24/2014 (Distance Contracts and Consumer Rights)
- Lei n.º 46/2012 (E-commerce Law)
- Regulamento Geral sobre a Proteção de Dados (RGPD / GDPR)
KialaRise is registered in Portugal and complies with all consumer protection, privacy, and online commerce obligations.
2 – Scope of Application
These Terms apply to:
- The use of our website by visitors
- Online purchases made through www.kialarise.com
- Communication with us via email, forms, or customer service
3 – Products and Services
All products sold on this site are described as accurately as possible. However, we cannot guarantee that descriptions, images, or pricing are always error-free. All prices are shown in EUR (€) and include VAT where applicable.
We reserve the right to modify or discontinue any product at any time without prior notice.
4 – Ordering and Contract Formation
When you place an order, you will receive an email confirmation. This confirmation does not yet constitute acceptance of the contract. The contract is only finalized once your order is shipped and you receive a second email confirming dispatch.
We reserve the right to refuse or cancel orders, particularly in the case of suspected fraud, incorrect pricing, or availability issues.
5 – Payments
We accept secure online payments trough multiple providers (e.g. Visa, Mastercard, PayPal, MB Way, etc.). All transactions are processed in accordance with EU Payment Service Directive (PSD2).
6 – Shipping and Delivery
We ship orders from Portugal to Portugal and Spain only. Delivery times vary depending on the destination. Shipping fees and estimated delivery times are clearly displayed at checkout.
Kiala Rise is not responsible for delays caused by third-party carriers or customs authorities.
7 – Returns and Right of Withdrawal (Direito de Livre Resolução)
As per Portuguese and EU law, consumers have the right to withdraw from the contract within 14 calendar days from the delivery date, without providing any reason.
To exercise this right, you must notify us via email (info@kialarise.com) and return the product in its original, unused and sealed condition within 14 days. Return shipping costs are the responsibility of the customer.
Exceptions:
Due to hygiene and safety reasons, the right of withdrawal does not apply to:
- Opened or used cosmetics, perfumes, or personal care products
- Custom-made or personalized items
8 – Refunds
Once your return is received and inspected, we will notify you of the approval or rejection of your refund. If approved, the refund will be processed within 14 days, using the same payment method used in the original transaction.
9 – Customer Obligations
You agree to provide accurate, complete, and up-to-date information when making a purchase. You may not use our site for any unlawful or fraudulent activity.
10 – Privacy and Data Protection
We are fully compliant with the General Data Protection Regulation (GDPR) and Portuguese data protection laws. For details on how we collect, store, and use your personal data, please refer to our Privacy Policy.
11 – Intellectual Property
All content on our site—including images, text, design, and branding—is the intellectual property of KialaRise or its partners and may not be used without prior written consent.
12 – Limitation of Liability
We are not liable for any indirect, incidental, or consequential damages arising from your use of the website or products. Our liability is limited to the amount you paid for the product, to the extent permitted by Portuguese law.
13 – Force Majeure
We are not responsible for delays or failures caused by circumstances beyond our control (e.g. strikes, pandemics, natural disasters, supply chain disruptions).
14 – Dispute Resolution
If a dispute arises, we encourage customers to contact us first via info@kialarise.com. If no agreement is reached, consumers residing in Portugal may:
- Submit a complaint to the Centro de Arbitragem de Conflitos de Consumo (Consumer Dispute Arbitration Center)
- Use the Online Dispute Resolution (ODR) Platform provided by the European Commission: https://ec.europa.eu/consumers/odr
15 – Changes to Terms
We reserve the right to modify these Terms at any time. The latest version will always be available on our website. Your continued use of the site after changes are made constitutes acceptance of the new Terms.
